Sobre el delito de maltrato de niños, niñas y adolescentes y de otras personas vulnerables

Abstract

El siguiente artículo aborda el problema relativo al maltrato de niños, niñas y adolescentes, incluyendo a quienes tienen alguna discapacidad. el análisis se hace con énfasis en la problemática global y nacional que existe respecto del maltrato infantil. a su vez, se relata el desarrollo histórico que ha experimentado la legislación de Chile, comentando sus principales reformas, para luego analizar la incorporación legislativa de los tratados internacionales sobre la materia, examinándolos en relación al Derecho internacional y al Derecho constitucional chileno. Finalmente se examina el proyecto de ley que agrega el maltrato de menores y de otras personas vulnerables como delito al código Penal, tanto desde la perspectiva dogmática, como también con énfasis sobre lo que ha dicho la corte suprema al informar sobre dicho proyecto a la cámara de Diputados.

The following article addresses the problem of abuse of children and adolescents, including those who have a disability. the analysis is made with an emphasis on the global and national problems that exist regarding child abuse. at the same time, the historical development of the chilean legislation is discussed, commenting on its main reforms, and then analyzing thelegislative incorporation of the international treaties on the subject, examining them in relation to the international law and chilean constitutional law. Finally, the bill that types the abuse of children and adolescents and other vulnerable persons as a crime against the Penal code is analyzed, both from a jurisprudential perspective, and also with emphasis on what the supreme court has said when reporting on the Project to the chamber of Deputies.
