Algunos comentarios a la ley Nº 20.680 que modificó el cuidado personal

Abstract

El presente trabajo analiza las reformas y consecuencias jurídicas introducidas por la ley nº 20.680 al código civil y otros cuerpos legales en materia de cuidado personal. Muestra como esta normativa es solo un engranaje de varias y sucesivas reformas cambios lentos y muy esperados socialmente - en materia de familia que han empezado a entender esta institución como una entidad más dinámica proscribiendo regulaciones vetustas y desfasadas concordándolas más a la realidad social imperante estribándose a través de los principios de igualdad, de interés superior del menor y de la protección de la familia, entre otros. Estudiaremos el mecanismo del cuidado personal a propósito de su regulación y las innovaciones que incorpora y la integración del principio de corresponsabilidad

The present paper analyzes the consequences and legal reforms introduced by law no. 20.680 to the Civil Code and other legislation relating to personal care. It shows how this legislation is only one of several gear-changes and subsequent reforms slow changes and very socially-expected in family matters have begun to understand this institution as a dynamic entity outlawing dilapidated and outdated regulations assimilating more to the prevailing social reality base and founded on the principie of equality, on the superior interest of the child and on family protection, among others. We shall study the mechanism of personal care as regards their regulation and innovations, it incorporates and the integration of the principie of joint responsibility.
